Agreement for professional immigration consultation services

By using the services of SouthPace Visa Solutions Ltd (SPVS), you agree to be bound by these Terms of Service. Please read carefully before engaging our services.

Immigration Consultation Services

SPVS provides professional immigration consultation services including:

  • Immigration eligibility assessments and advice
  • Application preparation and submission assistance
  • Document review and verification support
  • Case management and status tracking
  • Interview preparation and coaching
  • Appeal and judicial review assistance

Service Limitations

  • Not Legal Services: We provide consultation, not legal representation
  • No Guarantee: Cannot guarantee approval of any immigration application
  • Government Decisions: Final decisions rest with Canadian immigration authorities
  • Regulated Services: Operating within RCIC regulatory framework

📝 2. Client Responsibilities

Information Accuracy

Clients must:

  • Provide complete, accurate, and truthful information
  • Disclose all relevant facts that may affect their application
  • Update us promptly of any changes in circumstances
  • Provide original or certified documents as required
  • Respond promptly to requests for additional information

Compliance and Cooperation

  • Follow all Canadian immigration laws and regulations
  • Attend required appointments and interviews
  • Pay all government fees directly to authorities
  • Maintain valid status in current country of residence

💰 3. Fees and Payment

Service Fees

  • Professional Fees: As agreed in the retainer agreement
  • Government Fees: Paid directly by client to authorities
  • Third-Party Costs: Document translation, courier, etc. (additional)
  • Payment Schedule: As specified in individual agreements

Refund Policy

  • Service Rendered: No refund for completed services
  • Government Fees: Non-refundable once paid to authorities
  • Withdrawal: Partial refund may apply for unperformed services
  • Refusal: Professional fees are non-refundable if application is refused

🛡️ 4. Limitation of Liability

SPVS liability is limited as follows:

  • Maximum Liability: Limited to fees paid for the specific service
  • No Consequential Damages: Not liable for indirect or consequential losses
  • Government Decisions: Not responsible for immigration authority decisions
  • External Factors: Not liable for delays due to government processing
  • Client Information: Not liable for consequences of inaccurate client information

Regulatory Compliance

  • Services provided by Regulated Canadian Immigration Consultants (RCIC)
  • Adherence to College of Immigration and Citizenship Consultants standards
  • Professional liability insurance coverage
  • Continuing education and certification requirements

Confidentiality

  • Strict confidentiality of client information
  • Information sharing only with client consent or legal requirement
  • Secure handling and storage of documents
  • Professional privilege protection

Client Termination

Clients may terminate services by providing written notice. Fees for completed work remain due.

SPVS Termination

We may terminate services in cases of:

  • Non-payment of fees
  • Provision of false or misleading information
  • Non-compliance with immigration laws
  • Inappropriate conduct or communication
  • Conflict of interest situations

⚖️ 8. Dispute Resolution

Resolution Process

  • Direct Discussion: First attempt to resolve through discussion
  • Mediation: Good faith mediation if direct resolution fails
  • Arbitration: Binding arbitration for unresolved disputes
  • Governing Law: Laws of the jurisdiction where services are provided
